Conditions of sale

These terms and conditions of sale apply strictly to all sales made on our website “www.homecret.es” (hereinafter referred to as“SHOP”). Any order placed in the SHOP implies the unreserved acceptance by the CLIENT of the General Conditions of Sale of the SHOP that are in force and published on this website on the day on which the order is placed by the CLIENT. Furthermore, the Client assumes and acknowledges that the acceptance of these conditions of sale will directly affect the order placed and future orders for as long as the conditions of sale remain in force, i.e. until new ones are published in our SHOP.

The interpretation and application of these conditions and the acts derived from them shall be subject to Spanish law.

 

Cost

The prices published in the SHOP are in euros and are valid unless there is a typographical error.

The prices NOT include the VAT in force in Spain on the day of the order, but any change in VAT will be automatically applied to the prices of the products on sale in the SHOP.

Any product offer will be valid as long as it is visible in the SHOP at the time of placing the order.

If the CUSTOMER needs an invoice, it must be requested by e-mail, and only this will be legally valid.

 

Payments accepted and refunds

When making a purchase, the CUSTOMER may pay by debit or credit card, or by bank transfer. In the case of bank transfer, the order will not be considered accepted until confirmation of payment has been received from the bank, which usually takes 2-3 working days. The CUSTOMER will receive confirmation of the order at that time and will begin to prepare the shipment.

In the case of refunds for returned items, these will be made using the same method of payment used by the customer. The customer will receive the refund within a maximum of 14 days from the date the refund was sent and will be visible on the customer’s bank statement within a maximum of 5-7 working days from the issuance of the refund.

 

Products

The SHOP reserves the right to change its range of products depending on the conditions and supplies available from suppliers or the eventual shortage or absence of a product on the Spanish market. As for the offers made in the SHOP, they will only be valid until the limit of available stock is reached and within the dates set for said offer.

On the other hand, the images and descriptions of the products displayed in the SHOP are only indicative and do not imply any commitment on the part of the SHOP.

The SHOP has logistic agreements for the delivery of materials within 24-72 hours, however, these deadlines are subject to product availability and may be affected if the order involves a high volume of product, exceeding measures or weight of the standards set by our logistics providers (packages over 70 kg. or more than 120 cm in height, width or length). In this case, the customer will be advised to contact a personal SHOP assistant directly to assess availability, volume, shipping costs and delivery times.

 

User register

To browse the SHOP and add products to your shopping cart you do not need to register. However, in order to make a purchase it will be necessary for the CLIENT to register as a user. We will ask you for your personal details to generate your customer file. This data is protected in accordance with the provisions of Law 15/1999, of 13 December, on the Protection of Personal Data. Only persons over 18 years of age may register. With your user account the CLIENT will be able to make purchases and access possible discounts, offers and gifts that we offer to our customers. In your account you can consult your order history, your payment methods, addresses, etc.

 

Refund policy

In accordance with the provisions of the Ley de Ordenación del Comercio Minorista (Retail Trade Law) and EU regulations (Directive 97/7/CE), the SHOP offers a period of 14 days for the resolution or cancellation of the contract for distance purchases.

In the event of exercising this right of withdrawal, the customer shall bear the cost of return and any damage to the product or goods.

On the other hand, the SHOP (and in accordance with the provisions of the aforementioned Directive and the Law on the Regulation of Retail Trade) may consider that when the products requested by the customer are clearly personalised on the basis of specifications indicated by the consumer, the right of termination and withdrawal, as well as the present general terms and conditions, shall not prevail.

The SHOP will accept the return of the goods if:

  1. The buyer exercises his right to terminate the contract within the period stipulated by law (14 days). In such a case, the purchaser must pay the direct costs of return and, where applicable, pay for any damage to the object of purchase, in accordance with article 44 of the law on the regulation of retail trade. The SHOP will accept the exercise of the aforementioned right only and exclusively when the goods are in the same state (not unsealed, nor installed) in which they were delivered and ready for sale, with their corresponding original packaging and when they are in perfect condition.
  1. If the goods are defective: the SHOP will act in accordance with the provisions of the Law on Defective Products, immediately replacing the product with another with identical conditions and performance.
  1. The goods were not delivered to you within the timeframe informed by the SHOP.
  1. The SHOP will also refund the amount of the goods when, for reasons not attributable to it (whether direct or indirect), it is unable to deliver them.
  1. The SHOP will accept the return of goods when, for reasons attributable to it, the product ordered does not correspond to the one requested by the customer.

The SHOP will not accept returns in these cases:

• Made-to-measure products or products that are the result of a customised configuration, such as microcement kits, cut meshes, etc., and, in general, any product made to the consumer’s specifications, in accordance with Law 47/2002 on the Regulation of Retail Trade.

• No returns or exchanges are allowed for products purchased in person in our shops, only exchanges are allowed for distance purchases.

• Tested or used by the customer, which therefore means that they cannot be sold as new .

• Products handled by the customer. Returns must be made in their original packaging, perfectly protected.

• Goods that are returned incomplete in both main and accessory parts.
